How much do the attorney’s fees cost?
The fees for lawyers and courts are regulated by law. The fees are based on the value of the claim plus the work the lawyer needs to do. These numbers are used as a way to calculate the cost.
Value of the claim: in asylum proceedings, the value of legal action is set at 5000€ for one person and increases by 1000€ per family member. Sometimes we need additional requests filed and the value is set at 2500€ plus 500€ per additional family member.
Attorney’s fees: generally, these are based on the type and amount of work that has to be done (legal representation or legal action), where the proceedings take place (court hearings or out of court) and if the case has been rejected or appealed.

Family members are NOT persons belonging to one family. Family members are husband and wife and underaged children or underaged children and parents. Every other adult person may belong to the family but is not a family member:

In Human Welfare Law (Social Assistance Law), there is a maximum and a minimum amount a lawyer may charge. This is also regulated by law. The attorney decides on the fee based on the difficulty of the case and the amount of work needed. Monthly benefit claims fit into this category of law.

Who will pay the fees?
You pay the lawyer’s fees yourself. If you win the case, you will get your money back.
Is there legal aid?
In some situations there is “Prozeßkostenhilfe”. It is based on your income/financial background and the chances you have of winning the case. If you are not able to pay the fees but the case has a chance of winning, you can ask for Prozeßkostenhilfe. You may need to pay this amount back within 4 years if your financial background becomes better.
Is it possible to pay the fees in monthly installments?
Depending on your situation, monthly installments may be possible. An advance is necessary to maintain this agreement.
